1. Overview
These terms are an agreement between you and SpaceMine Ltd for your use of SpaceMine: our website at spacemine.net, the SpaceMine panel at panel.spacemine.co, the game servers and other services we provide, live chat and support. We call all of these the "services".
By creating an account, placing an order or using the services, you agree to these terms and to our privacy policy. If you use SpaceMine for an organisation, you agree for it and confirm you're allowed to.
2. Who we are
SpaceMine Ltd is a company registered in England and Wales (company number 11084250). Our registered office is 128 City Road, London, EC1V 2NX, United Kingdom. You can reach us at support@spacemine.net, through live chat or a support ticket in the panel, or on +44 20 4538 7800.
SpaceMine is not an official Minecraft service and is not approved by or associated with Mojang or Microsoft.
3. Your account
- You must be at least 18, or at least 13 with the permission of a parent or guardian who agrees to these terms for you and is responsible for your use of the services.
- Give us accurate details and keep them up to date, including your email address. We send invoices, renewal reminders and service notices there.
- Keep your password safe and turn on two-step verification. You're responsible for everything done through your account, including by team members you invite.
- Team members you add can use your services with the access you give them. You're responsible for their use, and you can change or remove their access at any time.
- One person or organisation may not open accounts to get around a suspension, a limit, or a free-tier allowance.
4. Our services
We provide game server hosting, starting with Minecraft Java Edition, in the plans and locations shown on our website and in the store at the time you order. Each plan comes with the resources described for it, such as memory, CPU and storage, and access to the panel to manage your server, files, plugins, backups, team and billing.
Some features are add-ons with their own price, such as dedicated IP addresses. The free tier, where offered, has lower resources and may have extra limits, including being stopped when idle.
We may change, improve or retire features, plans and locations. If a change materially reduces what you've paid for, we'll tell you in advance, and you can cancel before it takes effect.
5. Acceptable use
You may not use the services, or let anyone else use your server, to:
- break the law, or infringe anyone's intellectual property, privacy or other rights;
- attack, scan or disrupt any network or system, including ours and other customers' servers, for example through denial-of-service attacks, botnets or exploits;
- mine cryptocurrency, run proxies or VPNs for third parties, send spam or bulk email, or run anything unrelated to hosting your game server;
- distribute malware, or content that sexualises minors, promotes terrorism or violence, or harasses others;
- try to access accounts, servers or data that aren't yours, or get around limits, security measures or billing;
- use so much shared capacity, such as CPU, disk activity or network, that it harms other customers;
- break the Minecraft End User License Agreement and Mojang's usage guidelines, which you accept when you run a Minecraft server.
If we reasonably believe you've broken this section, we may suspend or stop the affected service without notice where needed to protect others, and we'll tell you why unless the law prevents it.
6. Your content and server data
Your worlds, files, plugins, configurations and anything else you upload or create on your server remain yours. You give us permission to store, copy, process and transmit them only as needed to run the services for you, including making backups and moving your server between machines.
You're responsible for your content and for having the rights to the software and files you install, including plugins and mods. We don't review what you put on your server, but we may remove or disable content that breaks these terms or the law.
7. Fees, billing and renewals
- Prices. Prices are shown in your account currency (US dollars by default) and include or add tax as shown at checkout.
- Billing. Services are billed in advance for each billing period, monthly unless you choose otherwise. Your service starts once the first invoice is paid.
- Renewals. Services renew automatically. We issue the renewal invoice up to 14 days before the due date and send reminders. If you've saved a payment method, we charge it on or after the due date. Account credit is applied to invoices first.
- Payments. Card payments are processed by Stripe. You authorise us and Stripe to charge your saved payment method for renewals and add-ons until you cancel.
- Price changes. We may change prices for future periods. We'll tell you at least 14 days before a change affects a service you already have, so you can cancel before it applies.
- Account credit. Credit added to your account can be used for SpaceMine invoices only. It can't be withdrawn, transferred or exchanged for cash.
- Chargebacks. If you dispute a payment with your bank instead of contacting us, we may suspend your services while the dispute is open.
8. No refunds
Payments are non-refundable. We don't give refunds or credit for partial billing periods, unused time, downgrades, cancellations, or suspensions caused by a breach of these terms, except where the law requires it.
Because your server is set up and available straight after payment, when you order you ask us to start the service immediately. If you're a consumer in the UK or the European Union, you may have a legal right to cancel within 14 days of ordering. If you use that right, we may deduct an amount for the service already provided up to the time you told us, as the law allows. Nothing in these terms affects your statutory rights as a consumer.
If something goes wrong on our side, contact us. We'll put it right where we can.
9. Suspension, cancellation and termination
Overdue invoices
If a renewal invoice is still unpaid 7 days after its due date, the service is suspended: your server is stopped and you can't use it, but your files are kept. Paying the invoice restores it. If it's still unpaid 14 days after suspension, the service is cancelled and its server, files and backups are permanently deleted. We send notices before each step.
Cancelling
You can cancel a service at any time in the panel. It stays active until the end of the period you've paid for and then ends; its data is deleted when it ends. Download anything you want to keep before then.
Our right to suspend or end services
We may suspend or end a service, or your account, if you seriously or repeatedly break these terms, if a payment is reversed or fraudulent, if the law requires it, or to protect the security of the services or other customers. Where reasonable, we'll warn you first and give you a chance to fix the problem. We may also stop providing a service altogether with at least 30 days' notice.
Closing your account
You can ask us to close your account at any time. Closing it ends all services. We keep some records after that, such as invoices, for as long as the law requires; see our privacy policy.
10. Backups and your data
Backup features help you protect your server, but they're not a guarantee against data loss. Keep your own copies of anything important, for example by downloading backups or files through the panel or SFTP. Backups are deleted with the service they belong to.
11. Availability and maintenance
We work to keep the services running around the clock, but we don't promise they'll be uninterrupted or free of errors. We carry out maintenance from time to time and announce planned maintenance in the panel and on our status page where we can. Servers may restart during maintenance or to recover from a fault.
12. Support, live chat and the AI assistant
We provide support through tickets, live chat and email. Live chat may first be answered by an AI assistant. It can give general help and, if you're signed in and the feature is on, read details of your own account to help, but it can't change anything on your account, and it can make mistakes. Ask for a person at any time. Nothing the assistant says changes these terms or our prices, and it can't promise refunds or credit.
13. Third-party software and services
The services include or work with software and services from others, such as Minecraft server software, plugins and mods you choose to install, Stripe for payments, and infrastructure providers. Their own terms apply to them, and we're not responsible for software you install or for third-party services we don't control.
14. Intellectual property
We own the SpaceMine name, logo, website, panel and our other software and content, or are licensed to use them. These terms don't give you any rights in them apart from the right to use the services as described. If you send us feedback, we may use it without any obligation to you.
15. Disclaimers
Apart from what these terms expressly say, the services are provided "as is" and "as available". To the extent the law allows, we exclude all other warranties, conditions and terms, including that the services will be fit for a particular purpose or meet your needs. This doesn't affect rights you have as a consumer that can't be excluded.
16. Limits on liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.
Subject to that, we're not liable for loss of data, profits, revenue, business, goodwill or opportunity, or for indirect or consequential loss, and our total liability to you for all claims in any 12 months is limited to the amount you paid us in those 12 months.
If you're a consumer, we're responsible for loss you suffer that's a foreseeable result of us breaking these terms or failing to use reasonable care and skill, but not for business losses.
17. Claims against us
If you use the services for a business, you'll cover our reasonable costs and losses from any claim by someone else arising from your content, your use of the services, or your breach of these terms.
18. Governing law and disputes
These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you're a consumer living elsewhere in the UK or in the European Union, you can also rely on the mandatory consumer protections of where you live and bring claims in your local courts. Please contact us first; most problems can be sorted out quickly.
19. General terms
- Changes. We may update these terms. We'll post the new version here with its effective date, and tell you by email or in the panel at least 14 days before material changes take effect. If you don't agree, you can cancel before then.
- Transfer. We may transfer our rights and obligations to another company, for example if our business is sold, as long as your rights aren't reduced. You can't transfer your account without our agreement.
- Events outside our control. We're not responsible for delays or failures caused by events we couldn't reasonably avoid, such as outages at upstream providers, attacks or natural events.
- Whole agreement. These terms, the privacy policy and your order make up the whole agreement between us. If part of them can't be enforced, the rest still applies. If we don't enforce something straight away, we can still do so later.
